Busted 6 months for hentai and lolicon

Usually people who get busted for hentai also had real child porn in their collection. This guy got busted for importing a bunch of lolicon manga from Japan.
Christopher Handley, the Iowa man on trial for possessing manga “drawings of children being sexually abused,” was sentenced on Thursday to six months in prison. Following this sentence, Handley must serve three years of supervised release and five years of probation. Both of these terms will start upon his release from prison and will run concurrently. Handley also agreed to forfeit all seized materials, including his computer. During Handley’s supervised release and probation, Handley must also “participate in a treatment program, to include psychological testing and a polygraph examination, as directed by the U. S. Probation Officer.” According to earlier court documents, this last provision is “intended to provide [Handley] with diagnosis and treatment for sexually and/or gender identity or other mental health issues.” Handley pleaded guilty to his charges in May 2009.
This guy didn’t possess any child porn and did not molest any children or anyone. This is the stupid community standards or Common Law at work. If the jury in your hick town thinks your funny books are an abomination in the eyes of the lord, well you’re fucked. Like some supreme court judge I don’t remember said, “I can’t give you a definition of pornography, but I know it when I see it.” I can’t give you the exact definition of what makes a stupid fucking moron, but I know one when I hear one.
The prosecution also stated that “The works at issue do not even have arguable scientific, literary, artistic, or political value, such as Vladimir Nabokov’s famed novel, Lolita, Shakespeare’s Romeo and Juliet.
It’s no art because I say so.
I’m also bothered by “diagnosis and treatment for sexually and/or gender identity or other mental health issues.” Can the judicial system decide if your gender identity is acceptable? Same for sexuality; that’s a thought crime.
“although honest with what he reported, was not disclosing enough to gain a complete picture of the nature and extent of [his] sexual deviancy … The main finding from the testing results is that Mr. Handley produced a guarded, defensive, and evasive profile. His test taking behavior suggests there is likely more to know about him than he is willing to disclose at this time.”
Christ, who wouldn’t evasive in the same situation. He’s being judge for his fantasies. Everybody’s got some fucked up fantasies and as long as they don’t hurt anyone they’re really nobody’s business. They really skrewed this guy’s life.

It sucks, but had he not plead guilty, he would have probably be forced to register as a sex offender.
Also, he didn't appear to be in a position to hire a big ass lawyer.
The jury had probably already decided his case before the trial even started. It's "what does your gut tell you" instead of beyond a reasonable doubt.

Reading both of those cases is making me angry enough to get light headed. I can't believe shit like this still flies in this day and age. Makes me wish somebody would cut out the tongues of everyone involved in the decision for violating free speech.

The trouble is where do you draw the line? Sure, the law protects free speech, but it also protects people from being abused by it. They take such material as being indicative of possible behavioral problems and the potential to engage in actions that are for lack of a better term illegal.
Though I can't say I agree with big-money firms using their financial resources to bully the public and the courts to do their bidding, there is something to be said for erring on the side of caution. Free speech doesn't mean complete and total anarchy.

I might have a bunch of pictures of seductive commissions of Cheetarah on my PC, doesn't mean that I think I'm anthroporphic IRL or that I want to fuck cats… but if someone accuses me of being sick in the head for liking said artwork, how can I defend myself against it?
What if I have a hard drive full porn actress Kitty Jung? The bit that scared me the most, Sirk, was the "…guarded, defensive, and evasive profile…" thing. The same could be said about a lot of us (for a fact, ME) in various situations. There's "more to know" about a lot of people, doesn't mean it is as sinister as it's made to sound in this context.

When does regulating speech become regulating thought (as Sirk pointed out)? The apparent justification seems to be that, "They have loli porn, that must mean they fuck or want to fuck kids". That would be akin to saying someone who engages in rape fantasies wants to get raped (here's a hint: they don't). That's not to say there aren't some people who view loli and are legitimately pedos, but how is it fair to lump innocent people in with them as well? At the end of the day, we are talking about a graphic depiction – a drawing. A drawing that only represents what the artist and the viewer perceives it as. If you think it is kiddie porn, maybe you're the one with the problem.
Please allow me to point out that this is all coming from someone that is not a fan of loli (HERESY!), but happens to know many that are.
I would also like to point the US isn't the only country with this problem. Not long ago, I found a blog with a Canadian complaining of his loli being confiscated on the way to his house (at least he wasn't arrested). I'll link you to it when I find it again.

While it is true that with freedom comes responsibility, with the laws that we implement to procure/ensure it should come trust between the enforcers and the public they've been hired to 'protect'. With each botched court case and 'police incident' (*cough*Dziekanski*cough*), that trust begins to wane. -_-!
There *is* a difference between fantasy and reality – enjoying depictions of one's fetishes is *NOT* the same as enacting them yourself.

- anthropomorphic animals and/or objects
- alternate body parts (ie hands instead of feet, pussy mouth)
- female characters being transformed into the above
- women getting stuck in glue
- skimpy costumes
- bondage
- softcore or even hardcore sex
then, as a thinking, reasoning **ADULT**, I should have that (constitutionally protected) right. I work, I pay taxes, I stay out of trouble (or, at least, I haven't been caught yet) ~_^
Why should I not be rewarded for my 'achievements'?

As for the right answer (and in reference to the Columbine comment): When I was a senior in high school, a buddy of mine and I ran Quake through almost the entire school computer system. Ran so rampant that even TEACHERS started jumping in deathmatches. The following year, shit went down in Littleton, and there was a big deal made about the shooters playing DOOM. If that would have happened one year sooner, we would have gone from lots of people having fun and letting off steam during study halls, to me and that other guy possibly being expelled because of mindless populous outrage and "zero tolerance" policies.

Similar story, but further back.
For an English assignment I wrote a story where the teacher got killed by a monster that came out of the toilet (he got sucked down the bowl). The teacher thought it was pretty funny. The French teacher also got killed and the English teacher showed him the story, since there was a feud between those two (thanks a lot Gianfranco!). The French teacher got pissed, but I wasn't in any real trouble.
A friend also showed my drawings of decapitations to the principal. He said it wasn't his cup of tea but it was nicely drawn.
I can't imagine the kind of shit a kid would get for that sort of thing today.

@Sirk, I think you CAN imagine the shit kids get for that sort of thing… think about the whole explosion of "Death Note" related disciplines a couple of years ago. People out of the know never realized it was a cartoon and trying to be the hero that saves the school, despite numerous other kids getting punished for the same thing and the show being brought up each time on national news fronts. Hell, if the show came out about 20 years ago, I would have made one too. Yes, I'm admitting that. :p
